For the purpose of these General Terms and Conditions (the “T&Cs”) and elsewhere on the website, “StudySmart.ai” refers to Good Ventures SAGL, a private company located at Via Chioso 25, 6983 Magliaso, Switzerland, with the registration number CHE-453.811.708. These T&Cs apply to all agreements and legal relations where Good Ventures SAGL is the provider of Services to the end-user (“User”).
StudySmart.ai (“SSAI”) offers services (“Services”) to Users. Services encompass access to an e-studying tool and knowledge made available through www.studysmart.ai or associated portals. The Services are provided “as is,” with SSAI reserving the right to modify them at any time at its sole discretion. Users should frequently review the Services for any changes.
SSAI’s Services should be used as supplemental tools alongside the User’s regular study methods. They do not replace any study or learning materials required by educational programs. The effectiveness of studying with SSAI is dependent on the User’s input and other varying factors, and SSAI makes no guarantees regarding the outcomes achieved through the use of its Services.
Charges for Services do not include costs associated with internet access required to use the Services. Users are responsible for any internet fees.
Subscription plans involve initial charges followed by recurring period charges, as agreed upon during the subscription selection (monthly, annually, etc.). By subscribing, Users acknowledge and accept responsibility for all recurring charges until they actively cancel their subscriptions. Automatic renewals will occur after the initial subscription period. To terminate or change payment methods, Users must adjust their settings through the ‘Preferences’ section in their SSAI account.
Subscriptions will auto-renew post the initial period. If cancellation occurs during this initial period, access will terminate at the end of the subscription term, without any prorated refunds for the remaining duration. Users should cancel their subscriptions mindfully, understanding that no refunds will be provided except where mandated by law.
SSAI is not responsible for the accuracy or completeness of User Generated Content. Users must rely on such content at their own risk and indemnify SSAI against claims arising from content they submit.
Users transfer all intellectual property rights of submitted works to SSAI. If you are unwilling to transfer these rights, you should refrain from using the service. In cases where complete transfer is not possible, SSAI is granted exclusive, irrevocable, royalty-free, perpetual, worldwide rights to use the intellectual property in question.
1. Use of AI Services: Good Ventures SAGL utilizes Artificial Intelligence (AI) technologies, including but not limited to third-party APIs such as OpenAI, to assist students in their learning. These technologies are integrated into our services to enhance learning experiences and provide additional support.
2. Quality of AI Services: While we aim to provide high-quality services, we do not guarantee that the AI support is always accurate, complete, or timely. We are not liable for any errors, omissions, or inaccuracies in the support provided by AI.
3. Limitation of Liability: Users are responsible for acting upon the AI support at their own discretion. Good Ventures SAGL shall not be liable for any damages arising out of or in connection with the use of or reliance on AI services.
Users must not submit content violating laws, SSAI’s rights, or third parties’ rights. Accounts involved in harmful or hurtful activities will be terminated immediately.
Agreements between SSAI and Users are indefinite but can be terminated by either party at any time for any reason, without refunds unless required by law.
SSAI’s use of personal data is outlined in the Privacy Policy found at www.studysmart.ai/en/privacypolicy.html.
SSAI may amend these T&Cs. Users will be notified via email or the website, with the right to terminate their agreement if they disagree with the changes.
Swiss law governs all legal relations between SSAI and the User.
